What are the top reasons for a workers' compensation denial?

You hope that you never suffer an injury on the job, but you realize that this could happen even if you are as careful as possible.

If you find yourself in this position, thankfully, you may look into your legal rights, such as the ability to apply for workers' compensation benefits.

While you may assume you qualify for benefits until you are able to return to work, this is not necessarily the case. There are many reasons why your claim could be denied, and you want to become familiar with each and every one.

Here are some of the most common reasons for a denial:

  • You did not report your injury to your employer in time
  • You did not file a claim in the proper manner in time
  • Your employer disputes your claim, such as by saying that you were injured outside of work
  • The injury is non compensable
  • You did not receive medical treatment immediately following the accident and injury
  • You are unable to prove that the injury occurred on the job

These are among the most common reasons for a workers' compensation denial, but others could come into play as well.

If you need to appeal a claim, you shouldn't hesitate to follow the steps outlined in your denial letter. Just because you run into trouble up front doesn't mean you are out of luck.

You have legal rights and you need to do whatever it takes to protect them. This could mean filing an appeal with the idea that you will be able to eventually receive the workers' compensation you deserve. Don't hesitate to take action, as time is of the essence.
